Terms of Service 2026-07-27-v2

1. Agreement to Terms

By accessing or using arrival.info, a product and service operated by Retro Day LLC ("arrival.info," "we," "us"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the service.

2. What Arrival.info Provides

Arrival.info provides pickup planning assistance for airport pickups by combining available signals (for example: arrival status, estimated times, traffic conditions, and user inputs) to produce suggested timing outputs such as "Leave Now", curb ETA, and change notifications ("Outputs").

Arrival.info is not an airline, airport, ground transportation provider, or safety-critical service.

3. Estimates, Not Guarantees

All Outputs are estimates and may be inaccurate, delayed, incomplete, or change without notice. Outputs depend on factors outside our control, including but not limited to airline operations, airport operations, traffic conditions, device connectivity, and third-party data availability.

You are responsible for verifying critical details using official sources and on-site instructions, including airline and airport signage, announcements, and staff directions.

4. Data Availability (Gate/Terminal/Baggage and Other Details)

Certain details (including gate, terminal, baggage, stand, or curb/location specifics) may be unavailable, delayed, incomplete, or incorrect depending on third-party sources and airline/airport reporting.

We do not guarantee that any particular field will be available for a given flight, airport, or time.

5. User Responsibilities

You agree to provide accurate inputs when requested, use Arrival.info only for lawful purposes, make final pickup decisions based on your judgment and official sources, and not rely on Arrival.info for emergency situations, safety-critical decisions, or time-critical actions where failure could cause harm.

6. Accounts

Some features may require an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

7. Guest, Personal, and Operator access

A coordinated pickup is one Arrival session associated with one resolved physical flight arrival. The session ends when the pickup is completed, cancelled, or expires. Unless otherwise agreed, a session expires no later than 48 hours after the flight’s current scheduled arrival time.

Guest: One complete coordinated pickup may be used without registration. A free account is required to create another unique pickup.

Personal: Free for non-commercial personal use, with no card or trial expiration. Under Published Plan Schedule version 2026-07-21-v3, effective July 21, 2026, Personal includes up to 2 active pickups, 2 new pickups per rolling 72 hours, 4 per rolling 30 days, 12 per rolling 180 days, and 5 provider-billed SMS segments monthly. Existing pickups remain operational if a creation limit is reached.

Pickup Boost: An eligible Personal account may purchase a one-time $7.99 add-on that starts after verified payment fulfillment, lasts 72 consecutive hours, permits up to 4 subsequent pickup creations, and raises the active limit to 3. It may be activated once per rolling 90 days, does not change the SMS allowance, does not renew, and has no wallet, credits, or carryover. Pickup Boost is not licensed for commercial use.

Operator: Commercial and organizational use requires an Operator plan regardless of volume. Starter, Pro, and Scale subscriptions renew monthly until cancelled. Monthly pickup and SMS usage resets on the subscription billing anniversary; rolling 72-hour usage is measured over the immediately preceding 72 hours. An active Operator pickup is a non-terminal session whose best available arrival time is within the live operational window: from 24 hours before arrival through 6 hours after arrival. Completed, cancelled, expired, creation-failed, and stale sessions do not count toward concurrency. Plan changes do not reset current-period usage. Cancellation remains effective through the paid billing period, after which new pickup creation is blocked; existing pickups remain accessible. Commercial credit packs and automatic overages are unavailable. Enterprise terms, support commitments, and custom capacity are governed by an executed order form.

Possession of a shared pickup link grants access to that pickup. You are responsible for sharing the link only with intended participants.

Reopening the same pickup does not create another billable pickup, and driver and passenger participation in the same session count as one pickup. Repeated creation of the same physical-flight pickup restores the existing session where applicable. A separately created pickup for another traveler or driver may count separately when it represents a distinct coordination operation. Current published plan details are available on the Pricing page. We may enforce limits to protect service reliability and prevent abuse.

8. Legacy Purchases and Refunds

Previously purchased pickup balances and already-paid pickups remain governed by the terms shown when purchased and will be honored or remediated as communicated to the purchaser. Unless required by law, delivered or activated purchases are final. If a refund is granted, it may be prorated and may revoke the related paid access.

9. Messaging (Push/SMS) and Carrier Limitations

Arrival.info Pickup Alerts is a transactional messaging program that may send phone verification codes and time-sensitive account, flight, or airport-pickup coordination alerts that you request. It does not include marketing or promotional messages unless you separately provide express consent for a distinct marketing program.

By checking an SMS consent box and providing a mobile number, you consent to recurring transactional text messages from Arrival.info Pickup Alerts at that number. Message frequency varies with your account and pickup activity. Message and data rates may apply. Consent is not a condition of purchase.

We will not sell, rent, or share your mobile number, SMS opt-in data, or SMS consent status with third parties or affiliates for their own marketing or promotional purposes.

Reply STOP to opt out of Arrival.info Pickup Alerts, START to resubscribe, or HELP for help. You may also contact [email protected]. We honor supported carrier opt-out and opt-in keywords in our consent and suppression records.

SMS and push delivery is not guaranteed and may be delayed or fail because of carrier, device, network, or third-party provider conditions. Carriers are not liable for delayed or undelivered messages.

10. Acceptable Use

You may not attempt to reverse engineer, scrape, or overload the service; use automated tools to generate excessive requests or notifications; circumvent access controls, paywalls, or usage limits; or use Arrival.info to violate laws, third-party rights, or privacy.

11. Third-Party Services and Content

Arrival.info may rely on third-party data providers and services (including maps, messaging, and flight/airport signals). Third-party services are outside our control, and we are not responsible for their outages, errors, or changes.

12. Service Changes and Availability

We may modify, suspend, or discontinue any part of Arrival.info at any time. We do not guarantee uninterrupted availability. Features may change, including availability, accuracy, and coverage.

13. Disclaimer of Warranties

Arrival.info is provided "AS IS" and "AS AVAILABLE." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

14. Limitation of Liability

To the fullest extent permitted by law, Arrival.info and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenue, data, goodwill, or business interruption.

We are not liable for missed flights, missed pickups, delays, scheduling errors, costs of alternate transportation, parking, tickets, or related expenses.

Our total liability for any claim relating to the service will not exceed the amount you paid to Arrival.info in the 30 days preceding the event giving rise to the claim (or $50, whichever is greater), unless required otherwise by law.

15. Indemnification

You agree to indemnify and hold harmless Retro Day LLC, doing business through arrival.info, and its affiliates from claims, liabilities, damages, and expenses arising from your use of the service, violation of these Terms, or violation of any rights of another.

16. Termination

We may suspend or terminate your access if you violate these Terms or if required to protect the service or other users. You may stop using the service at any time.

17. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of laws principles. Venue for disputes will be in Delaware, unless otherwise required by law.

18. Changes to Terms

We may update these Terms from time to time. Continued use after changes means you accept the updated Terms.
